The agreement

These terms are between you and Sympl, who operate Wherever Note. By creating an account you accept them. If you do not accept them, please don’t use the service.

Your account

You need to be at least 16 to create an account. Keep your password to yourself, and tell us if you think someone else has got into your account. You are responsible for what happens under your account.

One person, one personal account. Don’t create accounts automatically or in bulk.

Your content is yours

You keep ownership of everything you put into Wherever Note. You give us only the permission we need to store it, process it and show it back to you — for example, transcribing a recording so you can read it. We do not claim any other rights over it.

What you must not do

Don’t use Wherever Note to break the law, to store material you have no right to store, or to harm, harass or impersonate anyone. Don’t try to get into other people’s accounts, don’t attack or overload the service, and don’t attempt to work around any limits we apply, such as upload size limits.

Free accounts and limits

Personal accounts are currently free. There is no per-account storage limit in force today, so nothing will stop you saving because you have used up an allowance. Individual uploads are capped at 25MB each, which is well beyond a normal voice note.

Recordings you make are kept. Deleting a note hides it from the app but does not currently delete the recording behind it — if you need something genuinely removed, ask us and we will do it. See our privacy notice for how.

We may introduce storage limits later, and if we do we will give you reasonable notice before they start applying to your account.

If we introduce paid plans, your existing account will not silently start charging you. Any charge requires you to actively agree to it.

Availability, and being honest about it

We work to keep the service running, but we don’t promise it will be available without interruption or free of faults. It is provided as-is. We may change or withdraw features.

Wherever Note is a notebook, not a system of record. Please don’t rely on it as the only copy of anything you cannot afford to lose.

Ending it

You can stop using the service and ask us to close your account at any time. We may suspend or close an account that breaches these terms, and where it is reasonable to do so we will tell you why and give you a chance to put it right first.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for indirect or consequential loss, or for loss of data or profit.

If you are using Wherever Note as a consumer, you keep all your statutory rights and nothing here affects them.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
